The Review of the Marine Pollution Control Act

Because of the rise of the marine conservation concept, the understanding of marine ecology, environmental protection, resources conservation, as well as the disposal of contaminated waste, a gradual improvement has been taken. Although there are still pollution incidents happen, the situation of protecting marine environment has been gradually improved. Considering the purposes of long-term managing marine environment in the future, the author believes that we need a long-term consideration and continued implementation capacity to contribute the eternity of the ocean. That is the insight of the "Ocean Governance". In other words, the future goals should be to restore the marine ecology, to maintain a good marine environment, and to reconstruct the coexistence of human and oceans. It is the author’s thought that it would be important to maintain a good relationship between human beings and the oceans but without damaging the marine environment. Before the enforcement of Marine Pollution Control Act, the oil spill incidents of the “Borag” occurring in open waters near Keelung on February 7, 1977, makes serious damage to Taiwan. This incident expedites the Marine Pollution Control Act of Taiwan. This act was promulgated at the end of 1990, and the Amorgos oil-spilling incident immediately occurred at the south of Taiwan. Then after 10 years of implementation, it might be time to review the impact of the enforcement of this act and modify it. This research would try to collect, systemize and analyze these concerned regulations of international conventions or treaties at the first. Secondly, we will refers to and compares with municipal legal frameworks of other important states. Thirdly, this search will review these cases occured in Taiwan waters and literature on protection of maritime pollution. And we would raise a proposal of the draft amendment to the Marine Pollution Control Act. Finally, this search would verify the conclusion through the process of Regulatory Impact Analysis (RIA). The achievement of this research would be transformed into the draft amendments of Marine Pollution Control Act by the Environment Protection Administration, Executive Yuan.
